Supreme Court Affirms Parents’ Right to Opt Out of Gender & Sexuality Curriculum
|
Today’s U.S. Supreme Court ruling in Mahmoud v. Taylor marks a landmark victory for parental rights nationwide. In a 6–3 decision, the Court held that parents challenging the Montgomery County Board of Education’s refusal to grant religious opt-outs from mandatory gender and sexuality storybooks have demonstrated a likelihood of success on the merits of their First Amendment claims—warranting a preliminary injunction against the district.

By affirming that families have the right to opt their children out of classroom content that conflicts with their deeply held religious beliefs, the Court has reaffirmed a foundational principle: Parents, not the government, are the primary authority over a child’s education.

The Colorado Parent Advocacy Network (CPAN) proudly joined this fight by submitting an amicus brief alongside the Thomas More Society and four other parent advocacy organizations. Our brief urged the Court to restore balance and accountability to a public school system that has increasingly prioritized gender & sexuality instruction over academic education and marginalized families who dare to dissent.

“Most Colorado parents, regardless of background or beliefs, want their children to treat others with kindness and respect. So do we. But that’s not what this case is about. Every week, CPAN hears from parents, especially in elementary and middle schools, who are alarmed that academic time is being replaced with lessons on gender identity, sexuality, and personal pronouns, often without their knowledge or consent.

When schools push these topics without giving families a voice, it’s not inclusion, it’s the exclusion of parents.

Today’s Supreme Court ruling makes it clear: parental rights are not up for debate. Families have a constitutional right to guide their child’s moral and religious development.

We must protect the foundational right of parents to be part of their children’s education. It’s time to refocus our schools on academics and restore trust between families and the institutions meant to serve them.”
